Your privacy matters. NETRADIO NETWORK SAS processes your personal data in compliance with the European General Data Protection Regulation (GDPR — Regulation EU 2016/679) and applicable French data protection law. This policy explains what data we collect, why, and how to exercise your rights.

3. Why We Process Your Data (Legal Basis)

Contract performance: Processing necessary to provide the subscription service you purchased — account management, music submission, billing
Legitimate interests: Platform security, fraud prevention, service improvement, broadcast monitoring for the benefit of artists
Legal obligation: Accounting and tax records as required under French law
Consent: Sending marketing communications (you may withdraw consent at any time)

4. How We Use Your Data

To provide and operate the AirPlayRadio promotion platform
To submit your music to playlists, radio stations, and TV channels
To power AI features (AI Manager briefings, blog generation, image generation) using anonymized artist context
To send transactional emails (submission results, acceptances, billing notifications)
To monitor broadcast airplay via ACRCloud using your track's ISRC code
To display your public artist page if you choose to publish it
To improve our AI matching algorithms and platform performance
To comply with legal and regulatory obligations

5. Data Sharing with Third Parties

We share your data only with the following categories of third parties, all bound by confidentiality and data protection obligations:

Spotify AB — to verify artist metadata and retrieve track information via the Spotify Web API
Stripe Inc. — payment processing (subject to Stripe's privacy policy)
PayPal Holdings, Inc. — payment processing (subject to PayPal's privacy policy)
ACRCloud — broadcast monitoring using ISRC codes (no audio upload required)
Anthropic PBC — AI features powered by Claude (prompts do not contain raw payment data or passwords)
Leonardo.Ai — AI image and video generation for artist banners and promotional shorts
Cloudflare Inc. — CDN and R2 object storage for audio and image files
Apify Technologies — social media statistics aggregation via public APIs

We do not sell your personal data to any third party. We do not share your data with advertising networks.

6. International Data Transfers

Some of the third-party processors listed above are located outside the European Economic Area (EEA), including in the United States. Such transfers are carried out under appropriate safeguards including Standard Contractual Clauses (SCCs) approved by the European Commission, or the processor's certification under an equivalent adequacy framework.

7. Data Retention

Account and profile data: retained for the duration of your subscription plus 3 years after account closure, unless you request earlier deletion
Music files: retained as long as your account is active; deleted within 90 days of account closure
Billing records: retained for 10 years as required by French accounting law (Code de commerce)
Server logs: retained for 12 months
Support communications: retained for 3 years

8. Your Rights Under GDPR

As a data subject under GDPR, you have the following rights:

Right of access — obtain a copy of all personal data we hold about you
Right to rectification — correct inaccurate or incomplete data
Right to erasure ("right to be forgotten") — request deletion of your data, subject to legal retention obligations
Right to restriction — limit how we process your data in certain circumstances
Right to data portability — receive your data in a structured, machine-readable format
Right to object — object to processing based on legitimate interests
Right to withdraw consent — withdraw marketing consent at any time without affecting prior processing

To exercise any of these rights, email contact@airplayradio.com. We will respond within 30 days. You also have the right to lodge a complaint with the French data protection authority, the CNIL (Commission Nationale de l'Informatique et des Libertés).

9. Security

We implement industry-standard security measures including: Argon2id password hashing, HTTPS-only access (TLS 1.2+), encrypted data storage via Cloudflare R2, CSRF protection on all forms, and session-based authentication. Payment credentials are never stored on our servers.

Despite these measures, no system is completely secure. In the event of a data breach that poses risk to your rights, we will notify you and the relevant supervisory authority as required under GDPR Article 33.

10. Cookies

AirPlayRadio uses strictly necessary session cookies for authentication. We do not use tracking cookies, advertising cookies, or third-party analytics cookies. No cookie consent banner is required for strictly necessary cookies under GDPR and the ePrivacy Directive.

11. Children's Privacy

AirPlayRadio is not intended for users under the age of 18. We do not knowingly collect personal data from minors. If you believe a minor has created an account, please contact us immediately at contact@airplayradio.com.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes by email. Continued use of the platform after such notification constitutes acceptance of the updated policy.
